Here's a step-by-step description of how of your lawsuit proceeds.

First, Steve Mandel will send the other party involved in your case a letter, notifying them of your claims.

Next, if there's no immediate settlement, he will file a summons and complaint against those responsible for your injuries. These documents spell out your claims in detail. You are the plaintiff, and the other party is the defendant.

The defendant must answer within a specified time frame. Their answer will either admit fault, or deny their responsibility, and set forth their defenses.

The next phase of the process is called discovery. Both sides are required to provide factual information about issues relevant to the case. There is an exchange of documents and medical records requesting specific details about the incident during the discovery phase. You and the other parties named in the suit may be required to appear in a lawyer's office, so that you can personally tell your side of the story. Under New York law, this proceeding is called an "examination before trial", or EBT. You can be assured that Steve and his legal staff will carefully prepare you for this critical stage of your case.

At any stage of the process the parties can negotiate a resolution, rather than going to trial. It is here where having an attorney who is a skilled negotiator like Steve, can get you the largest possible compensation, without having to wait years and years.

As the case progresses, each party may file "motion" papers with the court. Motions are documents that detail certain facts and issues, where the law requires certain actions and responses. Depending on the circumstances of your particular case, these can speed up or delay resolution.

If there is no agreement as to a settlement, your case will then proceed to trial, before either a judge or a jury. Either side has the option of choosing a jury trial. Jury selection may follow, or a judge may decide your case. Steve will participate in selecting jurors, and based upon his knowledge and experience, will choose those most likely to rule in your favor.

At trial, The Law Firm of Steven J. Mandel, P.C. will present your case, calling on preeminent experts in medicine, vocational rehabilitation, engineering, economics and other relevant specialties to prove your case, as necessary.

At the conclusion of the case, the jury or judge will reach a decision, called a verdict. The verdict can compensate you for physical injuries, emotional and physical pain and suffering, future and past economic loss, medical expenses and other important elements of damages.

The resolution of your case may take only a few months, or sometimes several years. Steve Mandel will of course do all in his power to make sure you get the largest award or settlement, as quickly as possible. You'll be carefully guided every step of the way, and you will be kept informed as to everything that is going on with your case.

Personal injury lawsuits have a specific time period within which they can be filed. This is the "statute of limitations." If you do not file your case with this time frame, you lose your right to sue for monetary compensation. All personal injury cases are handled on a contingent fee basis.
